When acting against expulsion on the basis of the ban on expulsion contained in Article 19(1) of Legislative Decree No 286 of 1998, a Justice of the Peace is obliged to establish, under the duty of investigation to which he is subject and which is equivalent to a judge in international protection matters, any circumstances that were not made available to the Territorial Commission because the Applicant was unable to present or disclose them and the Commission was unable to establish them.

While an appeal against a refusal to grant international protection is pending, it is unlawful to expel an applicant before the decision on the case has been issued. The foreign national who has been expelled is entitled to a document that will allow his re-entry into Italy.

The court ordered the Office of Immigration and Nationality to conduct new proceedings. The mere fact that national security risk factors arise vis-à-vis a person is not sufficient reason to exclude them from refugee or subsidiary protection status.

This case concerned the assessment and reason given that the Applicant had not been subjected to “serious harm” in the past, in circumstances where the decision was unclear as to whether the finding was to the effect that his account was not believed, or whether, if believed, the harm was not inflicted by persons who were "actors of serious harm". The Court also considered the definition of “actors of serious harm.” Thirdly, the Court considered whether the decision-maker ignored the specific claim made in the application that returned asylum seekers face a risk of detention, interrogation and torture such as would amount to "serious harm".

A recognised refugee may only be refused a residence document if there are serious grounds to consider that he is a danger to the security of the Federal Republic of Germany.

The question as to whether a refugee should be refused a residence document because he supports a terrorist organisation can only be determined following a comprehensive, specific verification of the activities of the organisation and the foreign national based on an overall evaluation by the trial judge (following the decision of 15 March 2005 – Federal Administrative Court 1 C 26.03 - Federal Administrative Court 123, 114).

The detention of asylum applicants may undermine their ability to claim asylum and that an ‘effective remedy’ requires an appeal with suspensive effect against refoulement in order to prevent irreparable harm, sufficient time to prepare the appeal and effective legal assistance and interpretation.

Ireland - High Court, 27 April 2012, H.M v Minister for Justice and Law Reform, [2012] IEHC 176

In an application for judicial review, the High Court found that the Minister had not erred in relying on the Refugee Appeals Tribunal (RAT) finding as to credibility in a case where the Applicant’s claimed conversion from Islam to Christianity was found to have been in bad faith and solely in order to ground his applications for international protection. As the ‘conversion’ was not genuine, the Court held that there was no reason to believe it would come to the notice of the Afghani authorities should the Applicant be returned. This rendered it unnecessary to subsequently consider whether the Applicant would be at risk of serious harm by the authorities.

If a subsequent application for international protection is submitted, the administrative authority must evaluate whether the applicant has presented any new facts that, through no fault of the applicant, had not been the subject of examination in the previous proceeding. Otherwise, the application is inadmissible and the proceedings must be stopped.

ECtHR - Hirsi Jamaa and Others v Italy [GC], Application No. 27765/09

The case concerned Somali and Eritrean migrants travelling from Libya who had been intercepted at sea by the Italian authorities and sent back to Libya. Returning them to Libya without examining their case exposed them to a risk of ill-treatment and amounted to a collective expulsion.

This case concerned the concept of ‘safe country’ within the Dublin system and respect for fundamental rights of asylum seekers. The Court held that EU law prevents the application of a conclusive presumption that Member States observe all the fundamental rights of the European Union. Art. 4 Charter must be interpreted as meaning that the Member States may not transfer an asylum seeker to the Member State responsible within the meaning of the Regulation where they cannot be unaware that systemic deficiencies in the asylum procedure and in the reception conditions of asylum seekers in that Member State amount to substantial grounds for believing that the asylum seeker would face a real risk of being subjected to inhuman or degrading treatment within the meaning of the provision. Once it is impossible to transfer the asylum seeker to the responsible Member State then subject to the sovereignty clause the State can check if another Member State is responsible by examining further criteria under the Regulation. This should not take an unreasonable amount of time and if necessary then the Member State concerned must examine the asylum application.
