Headnote:

While an appeal against a refusal to grant international protection is pending, it is unlawful to expel an applicant before the decision on the case has been issued. The foreign national who has been expelled is entitled to a document that will allow his re-entry into Italy.

Facts:

The Applicant, a Moroccan citizen from Saharawi with a resident permit on grounds of subsidiary protection that had been cancelled, was held at a Centre for Identification and Expulsion. While in the Centre, he proceeded to submit a new application for protection that was declared inadmissible by the Territorial Commission. An appeal was lodged against the decision that the application was inadmissible. The Court suspended enforcement of the consequences of the declaration of inadmissibility. However, in the meantime, the Police in Milan proceeded with repatriation of the foreign national without waiting for the decision of the Court concerning the suspension. As a result, another appeal was lodged to obtain an order allowing the foreign national who had been expelled to return to Italy.

Decision & reasoning:

The Court held that Article 32 of Legislative Decree 25/2008, which regulates the application for suspension, should be interpreted in such a way as to allow a foreign national who has been the subject of an inadmissibility decision to remain in the country until a decision has been reached on the merits of the application for suspension. This is in line with the principle of equality and guarantees the ability to exercise the right of defence. For this reason, if such a possibility has been denied and the foreign national has been unlawfully expelled, the Administration should act to guarantee re-entry by issuing the relevant document.

Outcome:

Order to issue a re-entry visa.
