Austria – Federal Administrative Court, 17 November 2016, W111 2131009-1

In the course of an asylum procedure, the statements of the asylum seeker have to be assessed integrally. This includes, inter alia, an analysis of (up-to-date) country reports. However, such analysis is not carried out in a sufficient manner where there are only superficial references to the country of origin information. Rather, it is required that the information contained is actually taken into consideration when taking the decision, applied to the specific circumstances of each case and compared to the information provided by the asylum seeker(s).

If this is not the case, there are significant deficiencies in the administrative inquiry and the facts relevant for the decision are not fully established. Therefore, the contested decisions are to be annulled and the matters are to be referred back to the competent authorities for new decisions to be issued since there is no sufficient basis for a decision of an administrative court.

The Court quashed the decision of the Office of Immigration and Nationality (OIN) because it did not assess the Applicant’s fear of persecution in a due manner and held that there is a real internal flight alternative in an erroneous way, without due regard to the jurisprudence of the Court of Justice of the EU (CJEU)

ECtHR – J.K. v. and Others v. Sweden, Application No. 59166/12, 23 August 2016

The return of the applicants to Iraq violates Article 3 ECHR as there is a real risk of ill-treatment based on their personal circumstances as a targeted group and the Iraqi authorities’ diminished ability to protect them.

UK - R (FR and KL (Albania)) v Secretary of State for the Home Department, 23 June 2016

This case dealt with the issue of whether the Secretary of State’s certification of the asylum claims of the two independent applicants as “clearly unfounded” was flawed on public law grounds, and the important difference between a decision on refugee status itself and a decision on a claim being “clearly unfounded”.

Germany - Federal Constitutional Court, 2 May 2016, 2 BvR 273/16
Country of applicant: Syria

The decision of the Administrative Court Düsseldorf of January 8, 2016 - 23 L 3974 / 15.A, which ordered the removal of the complainant to Bulgaria, breaches his fundamental right under Article 3, paragraph 1 of Basic Law in its manifestation as a general prohibition on arbitrariness. The Administrative Court should have more closely scrutinised the newly available information on the situation pertaining to asylum seekers and persons with international protection status in Bulgaria.  The decision of the Administrative Court Düsseldorf is repealed and the case is referred back to the Administrative Court Düsseldorf.

Country of applicant: Mali

The three cumulative prerequisites for an internal protection alternative are not fulfilled, as it cannot be reasonably expected of the refugee to settle in the proposed part of the country. The UNHCR’s reasonability test is comparable with the national legislation’s one and UNHCR defines the internal protection alternative as ‘unreasonable’.

Poland - Judgement of the Voivodeship Administrative Court in Warsaw from 1 October 2015 no IV SA/Wa 685/15 annulling the decision of the Refugee Board on refusing refugee status, subsidiary protection and tolerated stay permit.
Country of applicant: Ukraine

The risk of persecutions should be assessed only on the basis of the current state of affairs or a prognosis of the situation in the foreseeable future, based on documented facts and not on general hypothesis regarding potential changes with no probability assessment. There is no doubt that in Ukraine there is a serious crisis, because of armed conflict in the part of the country, but for now there is no real risk that the conflict will cover the whole country.

The applicant is a member of a protestant church, while the dominating religion is orthodox. This circumstance should be duly taken into account when applying the internal protection alternative. The analysis whether the applicant’s fear of persecutions is well founded, should be based on updated information. The information was not updated since it came from April 2014 and the decision was taken in December 2014. The situation in Ukraine is dynamic so the appeal authority should complement the case files accordingly.

UK - A.A v. The Secretary of State for the Home Department, [2015] UKUT 00544

The degree of indiscriminate violence in certain parts of Iraq was such as to expose persons to a real risk of serious harm within the meaning of Article 15(c) of the Qualification Directive merely due to their presence there.

However, other areas of the country (including Baghdad City) did not meet this threshold, and as such, Iraqi nationals could be forcibly returned to these areas as it would not generally be unreasonable or unduly harsh for them to internally relocate there.

Country of applicant: Somalia

If an appellant provides substantiated reasons that call into question the consideration of evidence in the administrative proceedings, the facts cannot be regarded as “well established on basis of the records in combination with the complaint”. Thus, an oral hearing has to be held. The same applies if there is a necessity to consider up-to-date country of origin information as well as an up-to-date medical report due to the long duration of the judicial proceedings.

In the opinion of the court, the absence of a legal representative in the oral hearing, in spite of an explicit request by the appellant, does not constitute a grave violation of procedural rules. The relevant provisions does not provide for any legal consequences for such failure to act. However, this interpretation is not mandatory due to the lack of explicitly regulated legal consequences and requires further clarification by the Supreme Administrative Court.

Poland - Decision of the Refugee Board no RdU-326-1/S/2015 from 14 August 2015 on granting subsidiary protection
Country of applicant: Ukraine

The statement that the applicant can relocate within his country of origin is based solely on general information on Ukraine, without paying attention to his personal circumstances and conditions in the places he could be expected to settle in.

In the decision there is no reference to the applicant’s age, occupation, family situation, employment and housing opportunities, as well as his registration and the level of assistance he could benefit from if returned. The burden of proof to show that the personal circumstances of the applicant are not sufficient to counter a refusal of international protection on the basis of the internal protection alternative lies with the State authority.

The main question is whether the applicant can be sure that he will obtain assistance allowing for certain standards of living. The state assistance is significant here, as the applicant has no family or friends in the part of the country of origin under control of Ukrainians.
