ECtHR – O.M. v. Hungary, Application no. 9912/15, 5 July 2016
Country of applicant: Iran

The ECtHR found the detention of a homosexual asylum seeker in Hungary was arbitrary, in violation of Article 5(1) ECHR. In particular, the Court found that the Hungarian authorities had failed to make an individualised assessment and to take into account the applicant’s vulnerability in the detention facility based on his sexual orientation. The Court emphasised that the authorities should exercise special care when deciding on deprivation of liberty in order to avoid situations which may reproduce the plight that forced asylum seekers to flee in the first place.

Poland - Ruling of the Supreme Administrative Court from 29 June 2016 II OSK 2586/14 dismissing the complaint against a refusal of access to files in the case of a return of a third country national, 29 June 2016

Limiting the possibility to access classified information to the third country national does not automatically mean that their right to an effective remedy with regard to a return order was infringed. By the same token there has been no infringement of Article 47 of the Charter.

Hungary - Metropolitan Court of Public Administration and Labour, 20.K.31492/2016/9, 14 June 2016

The applicant arrived in Hungary as a child and her affiliation with Falun Gong was not properly adjudicated by the asylum authority (OIN) but her asylum application made as an adult was considered a subsequent one. Relying on Article 5 (3) of the Recast Qualification Directive, the OIN considered that the applicant and her mother were malevolent when joining Falun gong solely to evoke their sur place status. The court ruled that the OIN failed to individually assess the applicant’s claim and quashed the decision.

UK - London Borough of Croydon v Y, Court of Appeal, 26 April 2016
Country of applicant: Nigeria

The case considered an appeal by the London Borough of Croydon (“Croydon”) to have Y’s claim for damages for wrongful detention stayed pending the resolution of Y’s challenge to the assessment of his age undertaken by Croydon.

The Appellant submitted that the judge erred in holding that the principles in Starr v National Coal Board [1977] 1 WLR 63 (“Starr”) did not apply to this case. The Respondent argued that the Starr principles could not apply to this case. The Court upheld Croydon’s appeal, holding that the order sought by Croydon was reasonably necessary to enable it to defend the challenge to its age assessment and that Y had unreasonably refused to give his consent to the different age assessments applied for by Croydon.

Country of applicant: Mali

The three cumulative prerequisites for an internal protection alternative are not fulfilled, as it cannot be reasonably expected of the refugee to settle in the proposed part of the country. The UNHCR’s reasonability test is comparable with the national legislation’s one and UNHCR defines the internal protection alternative as ‘unreasonable’.

Italy - Ordinary Tribunal of Milan, 31 March 2016, n. 64207
Country of applicant: Gambia

The Italian consolidated Law on Migration (Art. 5(6) n. 286/1998) requires humanitarian protection to be given where a person is in a situation of vulnerability. Such a situation occurs when the applicant’s constitutional and international fundamental rights, such as health and nutrition, are compromised.

An Article 3 compliant assessment requires a full and ex nunc evaluation of a claim.  Where the State is made aware of facts that could expose an applicant to an individual risk of ill-treatment, regardless of whether the applicant chooses to rely on such facts, it is obliged to assess this risk ex proprio motu

Germany - Administrative Court (of) Hannover, case no. 1 B 5946/15, 7 March 2016

A member state may derogate from Article 3(1) of Regulation (EU) No. 604/2013 (the “Dublin-III-Regulation“), by examining an application for international protection despite the fact that the members state is not responsible for the examination according to the criteria laid down in the Dublin-III-Regulation.

When assessing Article 17 (1) of the Dublin-III-Regulation (the discretionary clause), the Federal Office for Migration and Refugees (the “Federal Office”) must give priority to the best interest of the child and the right to respect of family life. Furthermore, the Federal Office must take due account of the possibility of family reunification in accordance with Article 6 (3) (a) of the Dublin-III-Regulation.

In the event that an application for international protection allows for family reunification and also safeguards the best interests of the child, there is no room for discretion by the Federal Office in making an assessment under Article 17 (1) of the Dublin-III-Regulation.

Although Article 17 (1) Dublin-III-Regulation determines the responsibility of the Member States to examine applications for international protection, it governs not only the relationship between the Member States but also serves to protect fundamental rights. Thus, it also aims at the protection of the individual and provides for a subjective right, which can be enforced in a court of law.

UK - AT and another (Article 8 ECHR – Child Refugee – Family Reunification : Eritrea) [2016] UKUT 227 (IAC), 29 February 2016

A refusal to permit re-unification of family members with a child granted asylum in the United Kingdom can constitute a disproportionate breach of the right to respect for family life enjoyed by all family members under Article 8 ECHR despite the Immigration Rules not providing for family reunification where a child has been granted asylum in the UK.

UK - A.A v. The Secretary of State for the Home Department, [2015] UKUT 00544

The degree of indiscriminate violence in certain parts of Iraq was such as to expose persons to a real risk of serious harm within the meaning of Article 15(c) of the Qualification Directive merely due to their presence there.

However, other areas of the country (including Baghdad City) did not meet this threshold, and as such, Iraqi nationals could be forcibly returned to these areas as it would not generally be unreasonable or unduly harsh for them to internally relocate there.
