Headnote:
The decision of denying asylum is disproportionate, as the fact that the acts of persecution are indiscriminate and affect a large majority of the population do not exclude the application of the 1951 Convention when the necessary elements of the provision are present. The reports of UNHCR were also noted in the Court’s assessment, particularly regarding the risk groups that the organisation has characterised.
Facts:
The applicants, Syrian nationals, submitted an asylum application which was rejected on 2 July 2014. However, they were granted subsidiary protection. They appealed this decision, recognition of the right of asylum.
however, the court does not find enough evidence to declare the existence of the necessary element of persecution in order to grant asylum. Following this, they submitted an appeal to the Supreme Court.
Decision & reasoning:
The claim of the applicants is based on three grounds involving article 88.1.d) of Act 130/1992. They reasoned that the Court has erred in the interpretation of article 3 of Act 12/2009 and article 2.c) of the Directive 2004/83/CE in the relation of articles 6 and 7 of the cited Act and articles 9 and 10 of the Directive. This violation responds to the consideration of the Court that the alleged motives of persecution by the applicant are not related to article 3 of Act 12/2009 and the 1951 Convention. The applicants also argued an infraction of article 54 of Act 30/1992 in relation to article 24.1 of the Spanish Constitution as the Court did not make an expressed reference to the particular circumstances of the applicant. Lastly, they claim an infraction of article 218.2 and 218.3 of the Act 1/2000 as the Court did not take into account the Report of UNCHR and ACCEM, that state the need of granting asylum to the applicants, or the documents and references incorporated in the claim.
The Supreme Court concluded that article 3 of Act 12/2009 must be interpreted in light of the 1951 Convention and should contain an equilibrated and balanced examination of the facts and personal circumstances of the applicant to concur whether the necessary elements are present in the case. This means that it should not be interpreted restrictively, therefore the Court erred in their judgement due to their very narrow approach.
