CJEU - Case C‑163/17 Jawo, 19 March 2019

The CJEU ruled that an asylum applicant may not be transferred under the Dublin III Regulation to the Member State responsible for processing their application if the living conditions would expose them to a situation of extreme material poverty amounting to inhuman or degrading treatment within the meaning of Article 4 CFR. In this regard, the Court held that the threshold was only met where such deficiencies attained a particularly high level of severity beyond a high degree of insecurity or significant degradation of living conditions. Correspondingly, national courts had the obligation to examine, based on information that is objective, reliable, specific and properly updated and having regard to the standard of protection of fundamental rights guaranteed by EU law, whether there was a real risk for the applicant to find himself in such situation of extreme material poverty.

An act of absconding withing the meaning of Dublin III may be presumed when the applicant has left the accommodation allocated to them without informing the competent authorities, provided that they have been informed of this obligation, unless the applicant provides valid reasons for not informing the authorities.

The applicant, a victim of rape and forced marriage, has a subjective right to reception which allows her to live a life compatible with human dignity in light of her vulnerability and the minimum norms of reception. This right is entirely linked with FEDASIL’s competences to ensure reception is adapted to an individual’s circumstances. The statement of the asbl SOS VIOL clearly justifies why the applicant should be accommodated in a Local Reception Initiative, reception which is better adapted to the symptoms that she suffers from, notably anxiety and fear of men.The criticism of the asbl's statement whilist not providing any pschological assessment themselves, meant that FEDASIL’s decision not to transfer the applicant to adapted accommodation was negligent. 

The applicant is entitled to be transferred to individual accommodation and moral damages in the region of 2.500 euros.

When examining the acceptance of an asylum claim, the authorities have to study whether the testimony of the applicant is based on presumably true facts. Only if it is manifestly false could the admission of this application be denied.

The principle of family unity has to be taken into account regarding the assessment of the circumstances of the applicant, especially since his sister’s application for international protection was accepted.

Wishing to challenge his transfer to Germany from Luxembourg, the applicant appealed this decision and the court found that, on the basis of CJEU jurisprudence, all individuals had a right to contest the manner in which the Dublin III criteria are applied.

The Italian consolidated Law on Migration (Art. 5(6) n. 286/1998) requires humanitarian protection to be given where a person is in a situation of vulnerability. Such a situation occurs when the applicant’s constitutional and international fundamental rights, such as health and nutrition, are compromised.

A Gambian asylum seeker’s account of approximately eight years’ imprisonment and torture there was not considered credible. The Immigration Service and the Helsinki Supreme Administrative Courtconsidered the application to be manifestly unfounded and  the Supreme Administrative Court did not give leave to appeal on the matter. The UN Committee against Torture had, however, requested that the Applicant   not be returned to his home country, The Gambia, until UNCAT had examined the complaint.
