ECtHR - Hirsi Jamaa and Others v Italy [GC], Application No. 27765/09
Country of applicant: Eritrea, Somalia

The case concerned Somali and Eritrean migrants travelling from Libya who had been intercepted at sea by the Italian authorities and sent back to Libya. Returning them to Libya without examining their case exposed them to a risk of ill-treatment and amounted to a collective expulsion.

Although the asylum seeker has been unable to offer any credible account of the death penalty allegedly imposed on him due to his homosexuality, it must nevertheless be assessed whether, he has grounds to fear persecution or is in real danger of suffering serious harm in his home country due to his sexual orientation, and what weight must be given to the fact that he must hide his homosexuality to avoid this kind of threat. The judgments of the Administrative Court and the Immigration Service were overturned and the case was returned to the Immigration Service for further consideration.

CJEU - C-411-10 and C-493-10, Joined cases of N.S. v United Kingdom and M.E. v Ireland

This case concerned the concept of ‘safe country’ within the Dublin system and respect for fundamental rights of asylum seekers. The Court held that EU law prevents the application of a conclusive presumption that Member States observe all the fundamental rights of the European Union. Art. 4 Charter must be interpreted as meaning that the Member States may not transfer an asylum seeker to the Member State responsible within the meaning of the Regulation where they cannot be unaware that systemic deficiencies in the asylum procedure and in the reception conditions of asylum seekers in that Member State amount to substantial grounds for believing that the asylum seeker would face a real risk of being subjected to inhuman or degrading treatment within the meaning of the provision. Once it is impossible to transfer the asylum seeker to the responsible Member State then subject to the sovereignty clause the State can check if another Member State is responsible by examining further criteria under the Regulation. This should not take an unreasonable amount of time and if necessary then the Member State concerned must examine the asylum application.

The court found that a prohibition of deportation under Section 60 (2) of the Residence Act (corresponding to Art. 15 (b) of the Qualification Directive) was established due to the existence of a general risk of persecution in case of return to Syria. The Administrative Court, in their assessment of risk, went far beyond the prevailing case law, particularly that of the High Administrative Courts.

A particular mode of persecution cannot be detected in Syria due to the arbitrariness and the juxtaposition of different intelligence services, whose impact cannot be predicted.

A further deterioration of the situation has occurred in light of recent developments and the bloody suppression of the protest movements.

Currently even persons who have not been politically active in exile are, with considerable probability, at risk of being arrested on return, not only for a short period - they are also at risk of torture and other inhuman treatment.

The applicant came from a district in Afghanistan, which according to up-to-date country of origin information, also contained areas judged as being safe. When considering internal protection for subsidiary forms of international protection, the decision maker must also consider whether or not the applicant is able to reach these areas safely. The roads could not be considered safe and the other presented routes were also not considered feasible for the applicant. As the applicant could not resort to internal protection elsewhere, he was granted a residence permit on the grounds of humanitarian protection in accordance with section 88 a § of the Aliens’ Act.

The case considered whether the security situation in central-Iraq, and particularly in Baghdad, met the prerequisites for granting a residence permit on the grounds of subsidiary protection. It was confirmed that the need for international protection must be evaluated not only on points of law but also on points of fact. Both the applicant’s account of prior events in the country of origin, as well as current country of origin information regarding the security situation, must be taken into account in the risk assessment. As such, the evaluation is tied to a particular individual and to a particular time and place.

The facilitated standard of proof of Art 4.4 of the Qualification Directive was deemed to be applicable both in the decision-making on the granting of refugee status and in the decision-making on the granting of subsidiary protection. The "reduced standard of probability" (of sufficient safety), as it has been developed by the German asylum jurisprudence, is no longer relevant for the examination of refugee status or subsidiary protection. In case of a concrete danger of torture or inhuman or degrading treatment or punishment the prohibition of deportation of Section 60 (2) of the Residence Act applies unconditionally, this includes deportations to signatory states of the European Court on Human Rights.
