Applying the guidance on assessing internal protection found in Januzi and AH (Sudan) (see separate summaries), an applicant’s “home area” must be established as a matter of fact. The applicant’s social and economic position may assume particular importance where the applicant’s “home area” is rural and the area of proposed internal relocation is urban.
This case concerned the assessment of the option of internal relocation within Sierra Leone in the context of a threat from a family member. The Court found that, provided that regard has been had to relevant country of origin information, there is no obligation on the decision-maker under Article 8.2 of the Qualification Directive to seek out specific information on general economic and social conditions in a proposed site of re-location in the absence of any specific objection on that basis being put forward by the asylum seeker.
The term "act of persecution" within the meaning of the Qualification Directive requires that an intentional infringement of a basic right as defined in Art. 9.1 of the Qualification Directive takes place. If the applicant has suffered past persecution (before his/her flight), it is no longer possible to deny refugee status solely on the ground that an internal protection alternative had existed in another part of the country of origin at the time of the flight (change of legal situation in the light of Art. 4.4 of the Qualification Directive).
This case concerned whether or not a proper assessment of an internal protection alternative had been carried out. It was found that careful research had not been done regarding the question of whether a part of Colombia meets the internal protection criteria as set out in Art 8.1 of the Qualification Directive, taken together with Art 8.2 of the Qualification Directive.
This case concerns the definition of the term “internal armed conflict” within the meaning of Art 15 (c) of the Qualification Directive:
- When defining the term “international or internal armed conflict” as set out in Art 15 (c) of the Qualification Directive one has to take into account international law, in particular the four Geneva Conventions on International Humanitarian Law of 12 August 1949 and the Additional Protocols of 8 June 1977.
- An internal armed conflict within the meaning of Art 15 (c) of the Qualification Directive does not necessarily have to extend to the whole territory of a state.
- An examination of the requirements for subsidiary protection under Art 15 (c) of the Qualification Directive is not precluded if the authorities have issued a general “suspension of deportation”.
The Council of State ruled that significant similarities between accounts that were being presented by different asylum seekers with the same nationality, ethnic origin and provenance, who applied for asylum in the same period of time, was certainly remarkable, even suspicious, but that this suspicion alone does not suffice to establish fraud by the applicants.
The asylum procedure is a specific procedure as the applicants do not have knowledge of the Czech language. If an applicant submits documents in a language other than Czech it must be considered if it is the applicant or the Ministry of Interior who is responsible for providing a translation.
Members of a family, who are Russian citizens of Chechen ethnicity, who originate from Chechnya, can avail of internal protection (in the context of persecution by non-state actors, Section 60 (1) sentence (4) (c) of the Residence Act in conjunction with Art 8 of the Qualification Directive) in areas outside Chechnya, if one family member (in this instance the wife) possesses a new Russian internal passport, which is an important requirement for registration.
