Rights violations resulting from a forced marriage, including the use of physical and mental violence, constitute severe violations of basic human rights in terms of Art 9.1 (a) of the Qualification Directive.

The High Administrative Court was correct in holding that the circumstances upon which the recognition of refugee status was based have ceased to exist. However, it did not examine sufficiently whether a well-founded fear of persecution persists for other reasons.
Requiring a political activist to live away from his home area in order to avoid persecution at the hands of his political opponents has never been considered a proper application of the internal relocation principle. Indeed, the pitfalls of requiring a person to act contrary to his normal behaviour in order to avoid persecution have been further emphasised by the Supreme Court in HJ (Iran) (see separate summary in this database).
The applicant was granted a residence permit on the grounds of subsidiary protection. Based on up-to-date accounts of the security situation in central Iraq he was found to be at risk of suffering serious harm from indiscriminate violence in Baghdad, his region of origin, in accordance with Section 88(1)(3) of the Aliens’ Act. The ruling of the CJEU in Elgafaji v Staatssecretaris van Justitie (C-465/07) was taken into consideration in the case.
The case considered whether the security situation in central-Iraq, and particularly in Baghdad, met the prerequisites for granting a residence permit on the grounds of subsidiary protection. It was confirmed that the need for international protection must be evaluated not only on points of law but also on points of fact. Both the applicant’s account of prior events in the country of origin, as well as current country of origin information regarding the security situation, must be taken into account in the risk assessment. As such, the evaluation is tied to a particular individual and to a particular time and place.
The group of “Iraqi citizens who cooperate with the coalition forces” in Iraq is not to be characterised as a “social group” within the meaning of the Qualification Directive (confirmation of decision of Administrative Court of Karlsruhe of the 16 April 2010, A 10 K 523/08). It cannot be assumed that any kind of cooperation with the coalition forces is an expression of a certain political conviction or that Islamist terrorist organisations would have an understanding of this kind of cooperation.
Even if it is assumed that an internal armed conflict is taking place, a serious individual risk can only be established if the degree of indiscriminate violence which is characteristic of the conflict has reached such a high level that any civilian is at risk of a serious individual threat simply by his or her presence in the region.
The suicide attacks and bombings typical of Iraq and also of the hometown of the applicants can be classified as acts of indiscriminate violence. However, a density of danger as it is necessary for the assumption of a serious and individual risk cannot be established. Nor do the applicants possess individual characteristics which result in an increased risk for them when compared to other members of the civilian population.
Chechens, who do not have particular characteristics putting them at risk, are not at risk of persecution in the Russian Federation due to their membership of their ethnic group. Therefore it can basically be assumed that other parts of the Russian Federation provide an internal protection alternative.
This case concerned the concept of “particular social group." The CALL held that persons of the same sex can, in certain societies, be considered as a “particular social group.” The applicant, a victim of forced prostitution, was granted international protection on the basis of her belonging to the social group of women.
