Case summaries
This case concerned forced child labour in ther country of origin and sexual exploitation of the daughter of an Ethiopian father and an Eritrean mother, strained relations between the two countries, mass expulsions on the basis of ethnic origin, absence of a family network in the country of origin, total illiteracy, unequal treatment of single women, and an inability to integrate into society.
In relation to the absence of a family network, the case considered the stigma which may be suffered as a member of the particular social group of “single women in Ethiopia”.
Should she return to Ethiopia, it was considered likely that the Applicant would be totally ostracised to such an extent that she would be unable to integrate into society and enjoy her legal rights.
Young Nigerian women, especially those coming from the region of Benin City (State of Edo), who were forced to prostitute themselves in Europe in a transnational network of human trafficking, and who managed to extricate themselves from this network and to stop this forced activity, should not be seen as members of a particular social group in Nigeria. However, they face inhuman or degrading treatment in case of return to their country of origin and should therefore be granted subsidiary protection.
Prostitutes who come from the State of Edo, and who are both victims of human trafficking and anxious to extricate themselves actively from these networks, form a group whose members are, by reason of these two common characteristics which define them, likely to be subjected to persecution within the meaning of Article 1A(2) of the 1951 Refugee Convention, without being able to avail themselves of the protection of the Nigerian authorities. They are members of a particular social group.
An unaccompanied minor from Mongolia was granted a residence permit on the gounds of “particularly distressing circumstances”. The Court held that the applicant would be in a very fragile and vulnerable position if returned as she was a minor without a family or a social network, she suffered from psychological problems and would be forced to live in an orphanage. The Court noted that child labour, child abuse and the sexual exploitation of children are problems in Mongolia and that it is a source and transit country for trafficking.
Based on new evidence (suspicion of trafficking) the Administrative Court returned the applicant’s case to the Immigration Service which had previously decided that Italy was responsible for the application according to the Dublin II Regulation.
The Immigration Service refused an application for asylum deeming the application unfounded as the applicant had mainly based her claim for asylum on economic grounds. The applicant was taken into the System of Victim Assistance during the appeal stage on suspicion the applicant was a victim of trafficking. The Administrative Court held that in line with the Immigration Service’s decision, the application was deemed manifestly unfounded, but due to a suspicion the applicant was a victim of trafficking, returned the case to the Immigration Service for re-examination.
Trafficking in human beings falls under the prohibition of Art. 4 of the Convention. Consequently, state parties have the positive obligation:
- to adopt an adequate and comprehensive legal framework to combat this criminal offence;
- to undertake protective measures whenever the authorities are aware or ought to have been aware of a serious risk of a person being subject to trafficking;
- and to appropriately investigate situations of potential trafficking.
Although gender based persecution is not expressly mentioned among the reasons for recognising refugee status, the UNHCR Guidelines on claims to refugee status in cases involving gender based persecution, as cited by the Applicant, indicate that gender based persecution falls within the broader category of persecution for reasons of membership of a particular social group.
Although physical persons acting on their own behalf do not constitute typical perpetrators of persecution, they may be regarded as actors of persecution within the meaning of the Convention in cases where public authorities are unable or unwilling to protect an individual against their activities.
The appellants argued that they were at risk of re-trafficking and would not find protection anywhere in Albania. The tribunal agreed, and laid down country guidance on the risks facing trafficked women and the absence of effective protection from these risks.
