Austria: Supreme Administrative Court, 1 March 2018, Ra 2017/19/0425

In the assessment of a real risk of inhuman treatment or a serious threat to life or physical integrity in a situation of indiscriminate violence within an armed conflict, not only the general security and supply situation has to be considered, but also the “specific distinguishing features” of the applicant, which expose him/her to a higher risk than the average population.

In the present case, the Federal Administrative Court (Bundesverwaltungsgericht, BVwG) did not assess the individual circumstances of the applicant, disregarding the binding force of a previous ruling of the Supreme Administrative Court (Verwaltungsgerichtshof, VwGH).

In the case of doubts about family relationships, both the Federal Office for Immigration and Asylum (BFA) and the Austrian embassy abroad must for the purpose of family reunification enable applicants to have a DNA-analysis carried out at their request and inform them of this possibility. The purpose of this DNA-analysis is to enable the applicant to eliminate existing doubts about a family relationship and thus to achieve family reunification.

The Regional Administrative Court of Upper Austria requests a preliminary ruling of the CJEU concerning the interpretation of Article 29 Directive 2011/95/EU in the context of social assistance for persons entitled to asylum with a temporary residence permit.

1) Must Article 29 Directive 2011/95/EU, entitling persons subject to international protection to the same level of social assistance in the Member State as nationals of this Member State, be interpreted as fulfilling the conditions for direct effect as set out in the CJEU’s jurisprudence?

2) Must Article 29 Directive 2011/95/EU be interpreted in the way, that it opposes national legislation that provides for persons with a temporary residence permit the same level of social assistance as for persons falling under subsidiary protection, while persons with a permanent residence permit are allowed to the social assistance provided for nationals of the Member State concerned?

The applicants appealed the decision to deny family reunification and family extension in relation to the refugee status of their daughter. The Administration denied this claim based on the fact that the applicants have a different nationality than their daughter, which would contravene the requirement established in article 40.a) of Law 12/2009. Article 41 of said Act, however, addresses this specific situation; However, the requirement of developing this provision by regulation had not been complied by Spain. The Court assesses whether this article should be applicable in the current case, despite not presenting the requirement of regulation, and concludes that the similarity of the wording of articles 40 and 41 is enough as to deem the latter applicable.

Denmark - Refugee Appeals Board’s decision of 1 December 2017

The complainant is a Sunni Muslim from Mogadishu, Somalia. In July 2015 the Danish Immigration Service decided that his subsidiary protection status under the Danish Aliens Act. Art. 7 (2) had lapsed according to the Danish Aliens Act Art. 17 (1) and (4). The Refugee Appeals Board did not consider that the Danish Immigrations Service had lifted its burden of proof according to the Danish Aliens Act Art 17 (4). Consequently, the Board granted the complainant continued subsidiary protection under the Danish Aliens Act Art. 7 (2).

The complainant is an ethnic Galadi and a Muslim from Afgoye, Somalia. On 6 April 2017, the Danish Immigration Service decided not to prolong the complainant’s subsidiary protection under the Danish Aliens Act Art. 11 (2), cf. Art. 19 (1) no. 1 and Art. 19 (7) cf. Art. 26 (1).

After an overall assessment of the country of origin information the Board found that a deportation of the complainant to Afgoye no longer constitutes a violation of Denmark’s international obligations including ECHR article 3. However, regarding the assessment under the Aliens Act article 26, the Board found that due to the applicant’s economic, linguistic and social integration the Immigration Service’s decision to end the applicant’s subsidiary protection was incorrect. Thus the Board decided to uphold his subsidiary protection under the Danish Aliens Act Art. 7 (2).

In countries where there is a high prevalence of female genital mutilation (FGM), as in Nigeria, non-excised persons can be considered as having a well-founded fear of persecution for reasons of membership of a particular social group within the meaning of Article 1A(2) of 1951 Refugee Convention. Refugee status can be granted where there is a considerable risk of excision and insufficient protection against this threat.

The Constitutional Court ruled that Section 5(3) Nr. 4 NÖ MSG, which excludes beneficiaries of subsidiary protection from benefiting from social assistance out of the means-tested minimum income scheme when the person already receives social assistance covered by NÖ GVG is compatible with constitutional rights. It held that it does not constitute a violation of the principle of non-discrimination amongst foreigners. Given the provisional character of residence rights for beneficiaries of subsidiary protection such a legal rule falls within the wide margin of appreciation of the legislator.
