A Russian Federation citizen, originally from Chechnya, had applied for international protection in Finland due to threat of persecution based on his/her family’s political activities. The Applicant had been diagnosed with post traumatic stress disorder because of torture. According to the Immigration Service, he/she could resort to internal relocation as specified in Section 88e of the Aliens Act and there were no grounds for granting international protection. The Administrative Court rejected the appeal. The Supreme Administrative Court took the view that the Applicant has had close ties to the Komi Republic and had no problems with the authorities while living there. Therefore he/she can be expected to rely on internal relocation to another part of the country, as specified in Article 88e of the Aliens Act and he/she was not in need of international protection.

The Court stated that the applicant’s fear of persecution and serious threat, related to assaults by her former spouse  are unfounded because the Court believes that the applicant has a reasonable possibility of internal asylum in another part of her country of origin. Consequently, the Court rejected the applicant’s appeal  against the Office for the Protection of Refugees and Stateless Persons (OFPRA) decision refusing the grant of international protection).

The Respondent's evidence on the safety situation in Kabul and the possibilities for seeking employment, finding somewhere to live and establishing social networks provided the grounds for the Respondent's decision as well as for the judgment by the court of first enstance, both of which stated that the Applicant, in the event that he returned to Kabul, in his country of origin, would be provided with internal protection from serious harm, and that he is thus not entitled to subsidiary protection in the Republic of Slovenia.

The Applicant, an unaccompanied Afghan minor, stated that he had left his home country owing to his abduction and the threat of sexual abuse by the local ruler. The right to a decision by the statutory judge was violated by the fact that the decision on the application for international protection was made by a court panel consisting of two judges, one male and one female.

The Migration Court of Appeal returned the case to the Migration Court for investigation of whether there is an internal protection alternative for the man from Afghanistan. The Court found that an internal protection alternative must always be investigated as part of the protection assessment.

In order to determine whether an Applicant is exposed to a significant, specific risk stemming from an armed conflict, reference should be made to the actual target location of the foreign national upon return in the case of a localised armed conflict. This is often the region of origin of the Applicant. If the region of origin cannot be considered as the target location due to the risk facing the claimant, the latter may only be referred to another region in the country subject to the requirements of Article 8 of the Qualification Directive.

With regard to the evaluation as to whether extraordinary circumstances exist which do not come under the direct responsibility of the target deportation state and which prohibit the deporting state from deporting the foreign national according to Article 3 of the European Convention on Human Rights, reference should be made to the target deportation state as a whole in order to verify whether these circumstances exist in the location in which the deportation ends.

The Court granted permission to the Applicants to seek judicial review of the negative decision made in a written appeal (rather than an oral appeal) in an application for refugee status made by a South African one-parent family. The decision to allow a written appeal was based on the status of South Africa as a ‘safe country,’ and the appeal decision was based on personal credibility and the absence of a nexus to Convention grounds. The Applicants failed in their argument that the absence of an oral hearing may render the appeal decision unlawful by reference to the right to an effective remedy as guaranteed by the Asylum Procedures Directive, because the Applicants had in fact availed of the appeal rather than challenge the fact that it was confined to a written appeal. Leave to seek judicial review was granted on the basis that an aspect of the claim which was disclosed after the first instance decision was not properly considered; that the decision maker made exaggerated credibility findings to the potential detriment of a subsequent subsidiary protection application; and erred in the consideration of country of origin information and evidence of the availability of internal protection.
