The CGRS (Office of the Commissioner-General for Refugees and Stateless Persons) may not dispute the nationality of an asylum seeker without taking into account the official documents that he has filed.
In a challenge to a decision to refuse subsidiary protection and humanitarian leave to remain, the Court considered the obligation on the decision maker to consider relevant documentation, the obligation to give reasons for a decision to dismiss such evidence, reliance by the Minister on credibility findings by the RAT in denying the earlier application for refugee status and whether an Applicant is required to challenge the RAT findings in a subsequent application for subsidiary protection. The Court found that the Minister had failed to weigh the apparently corroborative documentation against the marginal findings of lack of credibility by the RAT or to give reasons for dismissing or rejecting such documentation.
This case concerned the conditions under which a refusal to perform military service for conscientious reasons may justify granting refugee status. The Minister for Public Order did not give reasons for deviating from the competent Committee's recommendation, nor did he find it to be ambiguous or to have any other legal defect, while he could have referred the case back to that body for reassessment. The application for annulment is granted.
A decision to transfer the applicant to Italy, solely based on Italy’s failure to respond to a request to take back the applicant, was insufficient, arbitrary and violated the applicant’s right to equal treatment. The Asylum Court had neither listed any criteria of the Dublin II Regulation that would indicate that Italy was responsible nor addressed the issues concerning the travel route of the applicant and his long stay in Greece.
The decision to expel an orphaned minor to Poland when he had a legal guardian in Austria gave rise to a real risk of a violation of Art 8 ECHR. The Asylum Court made its decision without providing clear reasons. The applicant’s family ties in the home country and in Austria must be considered, regardless of the duration of the applicant’s stay in Austria. The sovereignty clause must be applied when there is a real risk of a violation of Art 8 ECHR.
The case concerns the unlawfulness of detention in Hungary of two Ivorian nationals pending the asylum proceedings.
The procedure of the Court did not include decisive evidence for an assessment of whether, as a ground for revoking protection status, the complainant represented a danger to the security of the Slovak Republic, thereby infringing the complainant’s right to respond to all of the evidence, under Article 48(2) of the Constitution of the Slovak Republic and under Article 38(2) of the Charter of Fundamental Rights and Freedoms in conjunction with Article 13(4) of the Constitution of the Slovak Republic and Article 4(4) of the Charter of Fundamental Rights and Freedoms. The basis on which the competent authorities reach a decision must be clear from the administrative authority’s file and from the court file, even where no explicit reason is provided in the statement of reasons for their decision.
M’s detention pending deportation, for over 2 years and 8 months, was processed without sufficient safeguards against arbitrariness and delay, resulting in four separate violations of the Convention.
The case involved the rejection of an asylum application by an Iranian citizen of Kurdish origins who cited a fear of persecution because of his religious opinions and, specifically, having become a Christian. In support of his claims he submitted his baptism certificate and invoked the punishment stipulated by the legal system in his country of origin for changing his religion. The Minister for Public Order's decision on the party's application was annulled for being insufficiently reasoned.
The case concerned the interested party's obligation to cite specific facts which can provide evidence that the conditions for falling within the scope of the 1951 Convention had been satisfied. There must be a thorough examination of the main claims and a full justification of any negative decision in the case. If the Minister for Public Order adopts the Committee's negative judgment, then the relevant document must cite not only the interested party's claims but also the questions which were put to the foreigner and the responses he gave. The contested order – based on a defective opinion – referred in general terms to the Applicant not having shown a risk of persecution on racial, political or other grounds, and is deficiently reasoned. The application for annulment was granted.
