In the situation which currently prevails in Algeria, while homosexuality is in some ways tolerated by society, as long as it is not explicitly expressed by the behaviour or the clothes, individuals who openly manifest their homosexuality may nevertheless be subjected to intimidation in their social environment and by the security forces. In addition, legislation punishes homosexuals by a prison sentence and a fine.
The European Court of Human Rights found a violation of Article 5 para 1 (f), 4 and 5 with regards to some of the eleven applicants in this case, who were detained as suspected terrorists by UK authorities.
The House of Lords considered a number of issues arising out of the proposed deportation of three foreign nationals on the basis that each was a danger to the national security of the United Kingdom. The Court made three particularly relevant findings: (1) that Article 1F(c) of the 1951 Refugee Convention could be invoked to exclude an individual from the provisions of the Convention on the basis of acts committed after the applicant was recognised as a refugee; (2) Diplomatic assurances as to the treatment of an individual were relevant to assessing how an applicant would be treated upon return to their home State, though their assessment was a matter of fact, and; (3) relying on evidence obtained by torture in a criminal trial did not, as a matter of law, always amount to a flagrant denial of the right to a fair trial guaranteed by Article 6 ECHR.
The Ministry of Interior rejected the asylum claim of an Algerian woman who requested protection based on gender persecution by a non-state agent. The High National Court, on appeal, ruled that gender is considered as a “particular social group” and that it is not necessary that the persecution is carried out by state actors but also by non-state actors under certain circumstances. The applicant was granted Refugee status.
This was an appeal against the decision to deport an asylum applicant to Italy, when his brother had been admitted to the asylum procedure in France. The Council of State found that, under Art 9(2) Dublin Regulation, Italy was the responsible Member State. Art 8 did not apply as the definition of family members in Art 2(i) does not include siblings. Art 15 was not applicable since the applicant could apply for asylum in Italy. Only after Italy has made a decision the application would it be France's responsibility to decide whether to grant permission to enter and reside in France.
Having regard to the security situation which prevailed in the area of Chlef, the CRR did not consider that the Algerian authorities were, at the time, able to provide protection against the persecution inflicted by Islamic armed groups. Furthermore, given the impossibility of finding employment and the constant fear of being forcibly returned to this area, it was not reasonable to consider that Algiers constituted an internal protection alternative.
In assessing whether a state is a safe third country with regard to its interpretation of the 1951 Refugee Convention, it was not sufficient to assess whether the foreign state’s interpretation of the Convention was reasonable. The Secretary of State for the Home Department had to be satisfied that the foreign state applied the one true interpretation of the Convention decided upon by the UK Courts.
