The facilitated standard of proof of Art 4.4 of the Qualification Directive was deemed to be applicable both in the decision-making on the granting of refugee status and in the decision-making on the granting of subsidiary protection. The "reduced standard of probability" (of sufficient safety), as it has been developed by the German asylum jurisprudence, is no longer relevant for the examination of refugee status or subsidiary protection. In case of a concrete danger of torture or inhuman or degrading treatment or punishment the prohibition of deportation of Section 60 (2) of the Residence Act applies unconditionally, this includes deportations to signatory states of the European Court on Human Rights.

This case concerned the treatment of evidence from unaccompanied minors. The applicant was an unaccompanied minor from Afghanistan. He claimed asylum on the basis of a fear of persecution both by the Taliban and the Afghan government. The Refugee Appeals Tribunal refused his refugee appeal on the grounds that the applicant was not credible and that his claim was not objectively well-founded. The Court found that the Tribunal Member had engaged in impermissible speculation and conjecture in relation to the applicant’s prospect of State protection in Afghanistan, that the Tribunal Member had imputed expectations to the applicant without any consideration of the applicant’s level of maturity at the time, and that the Tribunal Member had failed to consider whether the applicant’s fears in relation to the Taliban were realistic having regard to his age, maturity and the particular circumstances in Northern Afghanistan.

This case concerned the refusal of a Refugee appeal on the basis that Sate protection was available and/or that the applicant could relocate within Nigeria and avoid persecution.  In support of the finding that State was available; the Tribunal Member relied upon part of a UK Home Office Operational Guidance Note (OGN) on Nigeria that had not been provided to the applicant. The Court found that the applicant not afforded fair procedures. She had no opportunity to comment upon the information in the OGN. The Court also found that the issue of whether or not State protection is available does not depend upon the existence of a police complaints procedure but upon a determination that there exists in the country of origin as a matter of current practice, an effective system for the detection, investigation, prosecution and conviction of crimes of the kind which form the subject matter of the complaint.

It is necessary to distinguish between the legal requirement to register a religious group under the law of the country of origin and enforcing such a registration with reasonable instruments permitted by the law, and the repressive actions of security units or other bodies of public authority towards members of a religious group that represent obvious excesses beyond the sphere of provisions permitted by law and which, at the same time, may, depending on particular circumstances, individually or on a cumulative basis, reach the intensity of persecution.

The accusation of a breach of the individual's right to information about the rules and procedures of the refugee status proceedings and about the rights and obligations of the applicant was unfounded, as the application form for refugee status contained this information and was signed by the individual in question to acknowledge that she had been duly informed.

For refugee status to be recognised on grounds of a risk of persecution by non-state actors, it needs to be shown that this risk is linked to persecution grounds listed in the Convention.

'Women subject to domestic violence' do not constitute a social group. The assessment of whether women in Russia constitute a social group within the meaning of the Convention requires an assessment of the actual situation in the country of origin.

A Lebanese woman was recognised as a refugee after a death threat by her brother because of her way of life. The court found:

  1. State protection doesn’t exist against ‘honour killings’ in Lebanon.
  2. Women who do not accept discrimination and denial of rights, which are based on tradition and social circumstances in their home country, constitute a particular social group in terms of Art. 10 (2) (d) of the Qualification Directive.
  3. Even a single person can be a non-state actor under Section 60 (1) sentence (4) (c) of the Residence Act (identical to Art 6 (c) of the Qualification Directive).

Violence, beating, and bullying constitute persecution, even if these acts are committed by the local community or individual members thereof.

It is vital to determine whether the applicant obtained help from the state when she requested it or whether there was a genuine (and not just theoretical) opportunity to seek protection.

This case concerned the argument that the decision of the Minister with regard to deciding whether to grant subsidiary protection must involve the same procedure as that which is applied in determining refugee status and that, in reviewing any such decision of the Minister, the courts must apply the same principles as apply to refugee determinations, rather than the principles that apply when reviewing the discretionary grant of humanitarian leave to remain or a decision as to non-refoulement. The Court held that nothing in the Procedures Directive required that the decision making process as to subsidiary protection should be the same as that for the refugee process, however if substantially new material was put forward in a subsidiary protection application it must be given a fair and reasoned consideration. The primary focus for deciding upon an application for subsidiary protection under the Qualifications Directive is on obtaining reliable and up to date country of origin information. It is not necessary for the Minister, in making such a decision, to engage in a dialogue with an applicant.
