Spain - High National Court, 8 July 2011, 302/2010
Country of applicant: Ivory Coast

The applicant claimed asylum in November 2009 alleging a well founded fear of persecution for reasons of race and religion. The application was refused by the Ministry of Interior on the grounds that the application did not amount to persecution in accordance with the 1951 Refugee Convention. On appeal, the High National Court re-examined the application and held that the conflict which had arisen in the Ivory Coast had to be taken into account and on that basis subsidiary protection should be granted.

The guidance in HJ (Iran) (see separate summary in this database) should be applied, by analogy, in cases where the applicant feared persecution on account of their religion. Consequently, the Tribunal had to consider the reason why an Ahmadi applicant for asylum had modified his behaviour by preaching only to people who would not put him at risk of persecution.

Greater caution is required when applying an internal protection alternative to families with children than to adults without children. The Kurdish controlled areas of northern Iraq cannot be considered as a relevant and reasonable flight option for a Christian family, as the Migration Board was not able to show that there currently is no requirement for sponsorship, either to enter or to legally establish oneself there.

An internal protection alternative must be relevant and reasonable. Relevant means that the location is accessible to the individual in a practical, safe and legal manner. The individual must also have access to effective protection at the location. That the option should be reasonable means that an individual assessment of the individual's ability to settle in a new location should be made, and of whether he or she has a social network. There ought also to be a realistic possibility for the individual to support himself and be able to live in a way that does not involve unnecessary suffering or hardship.

This case concerned the risk that Christian converts face in Iran. The applicants, from Iran, were granted a residence permit and refugee status because their Christian belief came to the Iranian authorities' attention.

The Supreme Administrative Court (SAC) returned the case to the Administrative Court for reconsideration based on the applicants' change of circumstance (conversion to Christianity in Finland) which only became apparent during the appeal before the SAC.

The Administrative Court did not consider credible the claim that the applicant’s conversion to Christianity had come to the attention of the Afghan authorities. The Court held that even if this information had reached the authorities, the applicant would not be at risk on return.

A foreigner who wishes to be placed under the special protection of refugee status must show the Administration, with reasonable clarity and in an objectively reasoned way, that there are specific facts which cause him to have a fear of persecution for reasons of race, religion, nationality, social group or political opinion. If such substantive claims have not been submitted, but only general, vague or manifestly unfounded claims; or if specific facts have indeed been cited but these do not establish grounds for refugee status, then there is no obligation to give specific reasons for rejecting the application for asylum. The “Handbook on Procedures and Criteria for Determining Refugee Status” issued by the UN High Commissioner for Refugees is non-binding in nature but contains “best practice” for the relevant authorities when examining asylum applications and, in that way, sets out “soft law”. Granting a residence permit on humanitarian grounds falls within the broad discretionary powers of the relevant authority; but it can, exceptionally, be obligatory if the foreigner would – should he be repatriated to the country of origin – be at risk of torture or other inhuman or degrading treatment or punishment.

The Iranian applicants’ asylum claim was rejected by the authorities as they were not found credible. As a result of this finding, the authorities did not consider their account in light of the country of origin information on Iran. The court quashed the decision and granted refugee status to the family reasoning that the authorities are obliged to carry out a thorough and complete fact assessment.

It was found that the contradictions in the applicants' account were not relevant from the point of view of international protection. The court also ruled that the authority is obliged to clarify misunderstandings at hearings, at the same time applicants have to be given the opportunity to justify contradictions and incoherencies in their statements.

According to the Qualification Directive, forced marriage, along with domestic violence and issues of faith, can be considered as persecution on a cumulative basis having regard to the situation in the country of origin.
