A major shift is currently taking place in the rules on burden of proof as regards the granting of international protection. It is up to the Commission and the courts to cooperate in checking the conditions that enable protection to be granted and they should obtain information concerning the country of origin by official means.
The fact that a party to proceedings has an unknown residence must always be proven in a credible manner, as must the exact determination of an address of residence in the territory of the Slovak Republic, and this obligation rests with the Court, which must exhaust all possibilities in determining whether the participant’s address really is unknown, or whether his address is other than the one known to the Court. Everyone has the right to have their case heard in court in their presence and to be able to comment on all of the evidence (Article 38(2) of the Charter of Fundamental Rights and Freedoms, Article 48(2) of the Constitution of the Slovak Republic).
The situation in Iraq is not characterised by an armed conflict within the meaning of Section 60 (7) (2) Residence Act / Art 15 (c) of the Qualification Directive. In any case, there is no sufficient individual risk for returnees.
This case concerns the definition of the term “internal armed conflict” within the meaning of Art 15 (c) of the Qualification Directive:
- When defining the term “international or internal armed conflict” as set out in Art 15 (c) of the Qualification Directive one has to take into account international law, in particular the four Geneva Conventions on International Humanitarian Law of 12 August 1949 and the Additional Protocols of 8 June 1977.
- An internal armed conflict within the meaning of Art 15 (c) of the Qualification Directive does not necessarily have to extend to the whole territory of a state.
- An examination of the requirements for subsidiary protection under Art 15 (c) of the Qualification Directive is not precluded if the authorities have issued a general “suspension of deportation”.
The situation of the homosexuals which currently prevails in Iraq enables them to be considered as forming a group whose members are likely to face acts of such gravity that they may amount to persecution in the meaning of Article 1A(2) of the 1951 Refugee Convention.
In view of the fact that the Regional Court failed to address the objections made by the Appellant in his appeal, unlawfully considered the Appellant to be making an application for recognition as a refugee sur place, failed to deal with the evidence submitted by the Appellant in conjunction with his appeal (that his case was different from an application for recognition as a refugee “sur place”), and since it was beyond doubt that the Court acted on outside of the subject matter of the appeal, it denied the Appellant the opportunity to have his objections heard before the Court.
The seven day detention of a ‘temporarily admitted’ asylum seeker under the fast-track procedure was non-arbitrary and consistent with Article 5(1), but the 76 hour delay in providing the individual with the real reasons for his detention did not satisfy the promptness requirement of Article 5(2).
There is not an internal armed conflict in Iraq. Also, the applicant has not shown that he is eligible for protection because of other severe conflict in the region.
Currently every Sunnite and Shiite from Central and South Iraq is to be considered as a refugee within the meaning of Section 60 (1) Residence Act and the 1951 Refugee Convention, if he/she originates from a region with mixed denominations.
Returnees who originate from regions of mixed denominations cannot obtain internal protection in any part of Iraq.
The CALL ruled that for the recognition of subsidiary protection status (serious threat to a civilian’s life or person by reason of indiscriminate violence in situations of international or internal armed conflict), where doubt exists as to whether a person is a civilian or not, that person shall be considered to be a civilian.
