In this application, the associations ask the Council of State to annul, for abuse of power, the decree n°2015-1329 of 21 October 2015 on the allowance granted to asylum seekers.
This decree is here annulled by the Council of State because its article 2 doesn’t provide for a sufficient additional amount for adult asylum seekers to allow them to seek private housing when they weren’t provided with an accommodation but had accepted material reception conditions.
D.T., who possesses a leave to remain in Poland due to humanitarian considerations, appealed the Municipal Appeal Board’s decision to uphold the decision refusing to award her child benefits. Relying on a purposive interpretation of the applicable regulations regarding social welfare and the access of foreigners to the labour market, the Court decided to set aside both decisions, while stressing that the deciding body shall be bound by the legal analysis contained in the Court order.
The Court of Appeal concluded that to send a refugee who has a residence permit in Italy and an asylum seeker back to the country would not violate Article 3 ECHR.
The court further constrained the decision in Tarakhel to families with minor children.
A Dublin Transfer to Italy should be prevented when the person concerned is a vulnerable person as per in Article 3 (2) Dublin III Regulation.
Taking into account, on the one hand relevant facts applicable to the administration and on the other hand facts relevant to the personal situation of the applicant, the Council of State rejects an appeal directed against a court order from the Administrative Tribunal of Toulouse denying the applicant’s accommodation request due to the lack of urgency of the applicant’s situation.
The case concerned an application for judicial review of the decisions made on behalf of the Secretary of State to transfer the applicants to Malta, on the basis that such jurisdiction was the proper place for considering the applicants’ asylum claims. The applicants argued that such transfer would violate their rights under Article 18 of the Charter of the Fundamental Rights of the European Union (EU Charter) to have their asylum application determined within a reasonable time and on the basis of a fair procedure, as the Maltese asylum system had several shortcomings and contains procedures that are illusory or too slow. Dismissing the application, the Tribunal concluded that there was no evidence to support the argument that the applicants’ Article 18 rights would be violated if they were transferred to Malta.
The asylum applicant cannot be transferred to Bulgaria because he would face a real risk of being subjected to inhuman or degrading treatment pursuant to Article 4 of the EU Charter of Fundamental Rights.
The transfer of asylum seekers from Belgium to Austria, under the Dublin Regulation, is contrary to the principle of due diligence, because the government has failed to obtain information on the effects of the moratorium of the processing of asylum applications in Austria.
The transfer of “extra vulnerable” asylum seekers from the Netherlands to Italy is contrary to article 3 ECHR.
It is unlawful to transfer an asylum applicant under the Dublin Regulation to a country, in this case Bulgaria, where the reception conditions conflict with Article 4 of the EU Charter of Fundamental Rights.
