It is necessary to distinguish between the legal requirement to register a religious group under the law of the country of origin and enforcing such a registration with reasonable instruments permitted by the law, and the repressive actions of security units or other bodies of public authority towards members of a religious group that represent obvious excesses beyond the sphere of provisions permitted by law and which, at the same time, may, depending on particular circumstances, individually or on a cumulative basis, reach the intensity of persecution.
The applicant claimed asylum on the grounds of having suffered female genital mutilation (FGM) and being subject to a forced marriage. The Ministry of Interior refused the application and the applicant lodged an appeal before the High National Court who also rejected the appeal (the applicant was granted a residence permit for humanitarian reasons). The applicant filed an appeal to the Supreme Court.
While Kosovan legislation prohibits any discrimination based on sexual orientation since 2004, persons who publicly acknowledge their homosexuality and demonstrate it in their external behavior regularly face de facto harassment and discrimination, without being able to avail themselves of the protection of the authorities. They constitute a particular social group.
The accusation of a breach of the individual's right to information about the rules and procedures of the refugee status proceedings and about the rights and obligations of the applicant was unfounded, as the application form for refugee status contained this information and was signed by the individual in question to acknowledge that she had been duly informed.
For refugee status to be recognised on grounds of a risk of persecution by non-state actors, it needs to be shown that this risk is linked to persecution grounds listed in the Convention.
'Women subject to domestic violence' do not constitute a social group. The assessment of whether women in Russia constitute a social group within the meaning of the Convention requires an assessment of the actual situation in the country of origin.
State protection should be assessed in the applicant’s home area, in the absence of an internal relocation alternative. The Tribunal erred in finding that the fact that the applicant had been raped at her home on 3 separate occasions over a short period by government soldiers had the same effect on assessing future risk as if she had been raped by civilians. The soldiers appeared to act with impunity whereas that would not necessarily be the case for civilians. In assessing future risk past experience was central, as reflected in Art 4(4) of the Qualification Directive and by common sense.
The right to obtain information about the whereabouts of a disappeared family member, as well as publicising the information concerning the disappearance, belong, according to the Czech Charter of Fundamental Rights and Freedom, to political rights. Therefore, the applicant must be granted asylum if he had been persecuted for exercising this right.
Gender may be a feature defining a social group, so women can be a particular social group.
Violence, beating, and bullying constitute persecution, even if these acts are committed by the local community or individual members thereof.
It is vital to determine whether the applicant obtained help from the state when she requested it or whether there was a genuine (and not just theoretical) opportunity to seek protection.
Where reports from applicant’s country of origin establish that the minority group to which the applicant belongs is a target of discrimination and persecution from the authorities and police, the applicant’s claim cannot be refused on the grounds that he/she had not asked the authorities for protection and failed to exhaust all legal means available.
Refugee Appeals Board/ Commission des recours des réfugiés (CRR) (CRR) held that the Somali government (Federal Transitional Government), was at the time of the decision, unable to effectively exercise organised power within Somali territory and under these circumstances to provide protection to the members of the Reer Hamar clan; no other authority is able to provide protection to the members of this community.
The application concerned the violations of Articles 2, 3 and 13 of the Convention following police officers’ excess powers used against the applicant during his arrest. The Court held that to be a violation of Article 2.
